Perhaps they should have brought Frank that Patagonian Toothfish for lunch….
KIRRAWEE Centre Pty Ltd, the company behind a proposed development on the former brick pit site, has thrown down the gauntlet, saying it will see Sutherland Shire Council in court.
[...]
Gymea Chamber of Commerce president, Ron Stapleton, had been at the forefront of community opposition to the development and said he was confident the council’s position would be supported by the courts. “You can only wait and see what happens now, I guess,” he said.
“But I think if it goes to court, everything being fair, it will get knocked back.”

They submitted one plan, then they tried the old switcheroo
Mr Brown said while the council might not have envisaged a development of the type proposed by the company, there was nothing in the original drafting of the development control plan to rule it out.

The council’s planning officers … never envisaged a shopping centre, and so to stop us, they are changing the rules after we’ve based and lodged our whole proposal on the current rules.”

Well cry me a river, we do not want an extension of the concrete jungle in the Sutherland Shire put in by greedy developers. The brick-pit should be rehabilitated into public greenspace, it would be a wonderful enchancement to the shire and a great place for families.
More parks less parking lots!
